Understanding your New Jersey Criminal or Traffic Case
The New Jersey Justice System is composed of certain distinct units, each of which is granted specific powers under State Law. New Jersey’s Constitution describes this organizational structure as follows: “Judicial power shall be vested in a Supreme Court, a Superior Court, County Courts, and inferior courts of limited jurisdiction.” The relevance of these divisions is immediately revealed when you or someone you love has been charged with a criminal offense or motor vehicle violation, as the nature of the crime, the degree of the charge, and the location of the offense will determine the legal venue in which your case is ultimately adjudicated. For example, if you have been accused of a felony, meaning a first, second, third, or fourth degree crime, such as robbery, resisting arrest, or a drugs and guns offense, your case will be transferred to the Superior Court in the county in which the alleged offense occurred. On the other hand, charges for lower-level criminal offenses, known as disorderly persons or petty disorderly persons offenses, will be heard and decided at the local Municipal Court in the municipality where your charges originated. Lastly, if you are a juvenile, general procedure dictates that your case be heard in the Family Division of the Superior Court in your county of residence.
